Police Shooting Involving Santa Fe County Sheriff’s Office

  Santa Fe County- On Thursday, September 16, 2021, the New Mexico State Police Investigations Bureau was contacted to investigate an officer involved shooting involving the Santa Fe County Sheriff’s Office.

Agents learned, at around 2:00 p.m., the Santa Fe County Sheriff’s Office responded to an armed individual, who was barricaded in the bathroom at the Allsup’s on Avenida Del Sur and New Mexico Highway 14 in Santa Fe, NM. The armed individual was an employee of the Allsup’s. When deputies arrived, they encountered the male subject armed with a firearm, in an embankment south of the store. As deputies attempted to speak to the male subject, he fired a shot in the air. The deputies retreated to a safe distance and called for assistance. The Santa Fe County SWAT Team responded to the scene. As the SWAT Team attempted to negotiate a safe surrender, the male suspect, still armed with the firearm attempted to evade deputies. A deputy fired a shot, striking the male subject.

The male subject who has been identified as Marvin Montoya (39) of Santa Fe, NM was transported to an area hospital where he is being treated for his injuries. Upon his release, Montoya will be facing criminal charges.

The name of the deputy involved will not be released until interviews are completed. No deputies were injured during the incident. For questions regarding administrative actions on the deputy, please contact the Santa Fe County Sheriff’s Office.

The New Mexico State Police Investigations Bureau agents are working to independently determine the series of events leading to the shooting, including collecting evidence and conducting interviews. Throughout the process, investigative findings will be shared with the district attorney for their review and consideration. The New Mexico State Police acts solely as factfinders in its cases and does not determine whether the actions of an officer were justified in these types of matters. That decision rests with the district attorney’s office.
