Las Cruces area man is sentenced to 8 years in Homicide by Vehicle (DWI)

Daniel Medina plead guilty and was sentenced to charges of Homicide by Vehicle (DWI) and one count of Great Bodily Harm by vehicle (DWI) and Driving While under the Influence of Intoxicating Liquor-a misdemeanor. District Court Judge Douglas Driggers presided over the sentencing. Medina was sentenced to 8 years outlined in his plea agreement. Assistant District Attorney Daniel Sewell represented the State.   

The crash happened at 1:20 am on April 27, 2019 on I-25, Las Cruces, New Mexico.  Involved in the crash were 2 vehicles and a motorcycle driven by Austin Lee Wagner.  Daniel Medina was the driver of the black truck, evidence from the scene indicated that Medina was driving on the wrong side of the road, he collided with a white truck driven by Jesus Adan Diaz, and the motorcycle driven by Wagner.   Wagner was deceased at the scene, Diaz sustained internal injuries and was transported to Mountain View Hospital.

During the accident interview with Medina, New Mexico State Police officers smelled odor of alcohol and attempted to administer a Field Sobriety Test, Medina refused.  He was arrested for driving under the influence and taken into custody.
