A hearing is set for January after a woman filed an appeal in a lawsuit over her professor's reaction to an essay in which she criticized lesbianism.
Judge M. Christina Armijo says the court erred when it denied the University of New Mexico's request to dismiss the case, a decision made before she'd seen Monica Pompeo's paper or the feedback from professors.
Pompeo and attorney Bob Gorence said in the lawsuit filed in 2013 that the professor kicked her out of class and refused to grade her paper.
Armijo wrote that professor Caroline Hinkley and her boss Susan Dever communicated with Pompeo repeatedly about editing her essay to meet academic standards, like explaining why attraction to the same sex is "perverse."
