Coalition Asks Court To Reconsider Water Ruling

By KRWG News

New Mexico – A coalition of environmental and agricultural interests is asking the New Mexico Court of Appeals to reconsider a water rights decision that was handed down last month.

The decision found that the Albuquerque Bernalillo County Water Utility did not have a proper permit to divert Rio Grande water for use in the metro area's drinking water system.

The Albuquerque Journal reports (http://bit.ly/u0qVFW) the coalition is objecting to some parts of the ruling. The group argues the ruling improperly restricts its right to raise its concerns as the water utility seeks a new permit for Rio Grande water.

The request of a rehearing before the appellate court is the first step in what is expected to be a lengthy process that will likely end up before the state Supreme Court.
