New Mexico – The New Mexico Supreme Court has ruled against Gov. Susana Martinez in a case brought by New Mexico's labor unions.
The court said Wednesday in a unanimous decision that the governor did not have authority to remove two members of the Public Employee Labor Relations Board. The court ordered the members reinstated immediately.
The justices said the board must remain free of the governor's control because it makes decisions on complaints brought against the governor and executive agencies.
The members who were ordered reinstated include John Boyd and Duff Westbrook.
The third member is chosen by the governor. Martinez appointed Wayne Bingham to that position two weeks ago.
