Las Cruces Man Held Without Bond on Aggravated Battery

Sean Hardy Lucky, 51, of Las Cruces was held without Bond in Third District Court.  Lucky is charged with 1 count of Aggravated Battery against a Household Member with a Deadly Weapon (1st degree felony), 2 counts of Battery against a household member (3rd degree felony), Larceny ($250 or less), and Tampering with Evidence.  District Court Judge Richard Jaquez found Aguilera to be Dangerous, and that Lucky failed to comply with conditions of release in his other cases and no Release Conditions will reasonably protect the safety of the community.  Lucky will remain in the Doña Ana County Detention Center awaiting a preliminary hearing.

Officers with Doña Ana County Sheriffs Department were dispatched to an attempted rape that happened on the road leading to the Mesquite Waste Disposal site.  The victim told the deputies that she had been picked up from her home by Lucky.   They drove to a Walgreens to purchase cigarettes and alcohol.  She told officers that Lucky was visibly upset from incidents earlier in the day. An argument ensued, she attempted to turn the vehicle off, so she could get out of the vehicle. Lucky allegedly struck her in the face and told her he was taking her out to the desert to humble her.   Stopping on the road to the Mesquite Waste Disposal site, Lucky dragged her out of the truck, he grabbed her cell phone, threw it into the brush, pulled out a knife he had on his person and cut off her dress.  He tossed the dress into the back of the truck and took off.  

Two workers from the site heard the struggle and found the victim hiding in the bushes, they gave her whatever clothing they had available to cover her.  The victim had visible lacerations, abrasions, bruising and swelling on her face, and a bite mark on her arm. She was transported to the hospital.

Lucky has additional pending cases of Battery; Breaking and Entering; Aggravated Battery (Great Bodily Harm); Aggravated DWI; Open Container; Possession of Drug Paraphernalia; and Battery (Household Member).
