No charges are expected to be filed against the driver of a sport utility vehicle that struck 6-year-old Jonah Frausto Saturday in a Las Cruces residential neighborhood.
Frausto died Sunday morning at an El Paso hospital.
Las Cruces Police and other emergency services were dispatched to the vehicle vs. pedestrian crash on the 700 block of Lees Drive at about 6:30 p.m. Saturday, April 15. Officers learned that Frausto was riding a non-motorized scooter when he emerged from the family’s driveway onto Lees. A blue Nissan Rogue was traveling south on Lees and struck Frausto as the boy entered the roadway.
Traffic investigators determined that the 66-year-old woman driving the Rogue was unable to stop before the vehicle struck the young boy. The woman was visible shaken from the incident but remained on scene and was cooperative with the investigation.
Frausto was rushed to Mountainview Regional Medical Center and then airlifted to University Medical Center of El Paso. He died at about 6 a.m.Sunday, April 16, at El Paso Children’s Hospital.
Officers shut down a portion of Lees Drive to conduct the investigation and determined that the SUV was traveling within the posted speed limits and the crash was unavoidable. No charges are expected to be filed in this incident.
