Charges Filed In Deputy-Involved Shooting Near Las Cruces

The 36-year-old man shot by a Doña Ana County Sheriff’s deputy on Sept. 24 has been charged with aggravated assault with a deadly weapon and negligent use of a firearm.

According to court documents, Daniel Carrillo, who lives in the 6300 block of Chula Vista Road in the East Mesa area of Doña Ana County, was at home with his father and a friend Tuesday night. Carrillo told detectives he and his father retrieved two firearms that were kept inside of a safe and began firing them into the air.

At approximately 10:30 p.m., numerous calls were made to 911 from residents in the Chula Vista area, reporting they had heard gunshots from several blocks away. Two Doña Ana County Sheriff’s deputies responded, followed by two additional units.

Officers with the Las Cruces Police Department also responded.

One sheriff’s deputy was reportedly approached by Carrillo, who allegedly pointed a weapon at the deputy. The deputy fired his duty weapon, striking Carrillo three times in the hand and torso. He was transported to an El Paso-area hospital where he is still being treated.

According to detectives, Carrillo was reportedly intoxicated at the time of the incident.

The deputy involved in the incident has been placed on paid administrative leave for the duration of an internal investigation and is not being identified at this time.

The incident is being investigated by the Officer Involved Shooting Task Force, a multiple-agency unit that includes the Doña Ana County Sheriff’s Office, the Las Cruces Police Department, New Mexico State Police and New Mexico State University Police.
