Las Cruces Imposes Fireworks Restrictions
The Las Cruces City Council at a special meeting Monday determined that drought conditions exist to the level that it can impose maximum restrictions on the use of fireworks.
According to NMSA 1978 60-2C-8.1, municipalities can impose restrictions regarding the sale, use and possession of fireworks. All aerial and ground devices are currently prohibited within the Las Cruces city limits. According to state law, this is the most restrictive a municipality can be.
Residents are not allowed to use fireworks in any wild land area and can only use permissible fireworks on paved or barren areas with a readily accessible source of water nearby.
The Las Cruces Fire Department reminds residents that the use, sale or possession of any aerial or ground audible device, to include aerial spinners, helicopters, mines, shells, missile type rockets, stick type rockets, roman candles, chasers and firecrackers is illegal within the City of Las Cruces.
Permissible fireworks allowed to be purchased and discharged are ground and hand-held sparkling, and smoking devices:
-Cone Fountains
-Crackling devices
-Cylindrical fountains
-Illuminating torches
-Toy smoke devices
-Wheels
Fireworks purchased outside of Las Cruces may be prohibited within the city, and if possessed or discharged within the city limits may result in citations or fines.
